Housing Discrimination
Our speciality is housing discrimination. We have assisted the advancement of many prominent housing discrimination cases in federal court, state court, and state administrative agencies. Many of our cases have been relating to discrimination against organizations who offer housing to individuals with substance use disorder, and we have helped these clients recover substantial damages with remarkable and consistent success. Individuals or organizations who believe they have been damaged may retain us to assess their claim, the likelihood they will prevail, and potential damages to be awarded.
Luckily, case law is clear and applied uniformly in most cases. Damages are typically significant and our clients are surprised that often our recommendation is not to settle as judgements are often much higher than expected, provided the case is advanced appropriately.
Receivership
A significant judgement is meaningless to a plaintiff if uncollectable. A large part of our work is supporting plaintiffs in securing the ability of the defendant to pay a large claim, often early in the process of litigation. Our typical process is to work with the attorney trying the case to have the court order a receiver to dispose of company assets in order to raise funds to pay an eventual judgement. This is very often granted if argued appropriately, and is far superior to waiting until the award of a judgement just to be confronted with a collection problem.
Real Estate Attachment
Another powerful tool we bring to our clients is advisory surrounding the attachment of assets in order to secure the payment of judgements or settlements. Even early in litigation, we are often able to obtain for our clients attachments on real property. This process is simple and granted immediately if argued correctly. Case law is clear, yet often unknown to most litigators.
